Do i need to get my daughter's father to relinquish his rights so that I may gain guardianship?

my daughter is mentally handicapped. I have custody. My daughter's father is not in her life due to the fact he is a child molester (convicted). Does he have to relinquish his parental rights before I can gain legal guardianship of her before she turns 18 next year?
